These Neocash Shopping Rules are the agreement between you and Nickelodeon Virtual Worlds Group, a unit of MTV Networks, a division of Viacom International, Inc. ("Us" or the "Company") that sets forth the license by which you acquire the right to use Neocash or the virtual items and services ("Neocash Items") available through the use of Neocash.

1. By purchasing Neocash, the Company hereby grants you a limited non-exclusive, non-transferable license to use Neocash and the Neocash Items within the functionality of the Neopets or Petpet Park websites. You acknowledge and agree that you do not acquire any ownership rights in or to the Neocash or Neocash Items, in whole or in part by purchasing this license to use Neocash or any Neocash Items. Once you purchase Neocash, the Neocash cannot be transferred to another Neopets or Petpet Park account nor can the Neocash Items be transferred to another account except through the gifting functionality provided in certain instances.
2. Your license to use Neocash and the Neocash Items is contingent upon you obeying the respective site's Terms and Conditions which are incorporated herein by this reference. The Company, in its absolute discretion, will determine whether you are obeying the respective site's Terms and Conditions. If you violate any applicable Terms and Conditions, your account(s) and your license to use existing Neocash and Neocash Items in your account(s) may be terminated at the Company's absolute discretion. The Company has no obligation or responsibility to and will not reimburse you for any Neocash or Neocash Item lost due to your violations of this and any other Company rules, policies, notices and/or agreements.
3. You understand that all purchases of Neocash are final and non-refundable, except, in our sole and absolute discretion. Once you purchased Neocash, you can't get your money back. YOU UNDERSTAND AND AGREE THAT ONCE YOU AUTHORIZE THE COMPANY OR OTHER DESIGNATED PAYMENT SERVICE TO CHARGE YOUR CREDIT CARD FOR A CERTAIN AMOUNT, SUCH AMOUNT SHALL UNDER NO CIRCUMSTANCES BE REFUNDABLE, INCLUDING WITHOUT LIMITATION, UPON TERMINATION OF YOUR ACCOUNT FOR ANY REASON, TERMINATION OF THIS AGREEMENT, TERMINATION OF THE NEOCASH SHOP AND/OR THE DISCONTINUATION OF THE NEOPETS WEBSITE.
4. You understand that Neocash will expire after one year and that upon expiration you will be given a Neocash Item of equal or greater value. Neocash will be included in your account until (a) you use the Neocash to license Neocash Items, (b) the associated expiration date or (c) your account is otherwise terminated pursuant to this Agreement, whichever is sooner. Each Neocash Item that you purchase using Neocash will be included in your respective account(s) until: (a) that Neocash Item's expiration date, (b) you transfer the Neocash Item through permissible functionality on the site; (c) or your applicable account(s) is otherwise terminated pursuant to this Agreement, whichever is sooner.
5. In order to obtain Neocash, you will be required to provide us or another payment service designated by us (e.g., PayPal) with your credit card information and other information related to your credit card transaction (e.g., your billing and shipping address on record with the applicable credit card company, your credit card expiration date, etc.). We shall not be responsible or liable for any credit card or bank-related charges or fees related to any of your transactions.
6. You understand that any credit card transaction-related information will be treated by Company in the manner described herein and in the respective site's Privacy Policy, and, as applicable, in the manner described in the respective privacy policies of any third-party payment service that we choose to use. You agree that all transaction-related information that you provide to Company or a designated third-party payment service will be accurate, current and complete. You hereby agree to pay all charges incurred by you (or your child, if applicable) resulting from your use of the Service at the price(s) in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to such transactions.
7. The Company reserves the right, without prior notification, to limit the order quantity on any Neocash Item and/or to refuse to provide you with Neocash or any Neocash Item. Verification of certain information applicable to a purchase of Neocash or a Neocash Item may be required prior to Company's acceptance thereof.
8. Price and availability of the Neocash Items are subject to change without notice.
9. You understand that we may suspend or terminate your Neopets or Petpet Park account if for any reason a charge you authorize us to make to your credit card cannot be processed or is returned to us unpaid and, if such event occurs, you shall immediately remit to us payment for such charge through the use of another credit card or other payment mechanism. Any purchase of Neocash that is declined or cancelled will result in the user and his household being permanently banned from the respective website(s) at our absolute discretion.
10. The Company has no liability if someone obtains your password to your Neopets or Petpet Park accounts.
11. The Neocash Shopping Rules set out above are effective as of May 15, 2007. Your use of Neocash and the Neocash Items is subject to these Neocash Shopping Rules and the respective Terms of Use Agreement. By using this Site, you are accepting the practices set out in this Neocash Shopping Rules and the respective Terms of Use. We reserve the right to modify the Neocash Shopping Rules at any time by posting the changes on this page. Your continued use of any portion of the respective Sites following posting of the updated Neocash Shopping Rules will constitute your acceptance of the changes.
12. In interpreting the Neocash Shopping Rules, the English version governs the interpretation and meaning of the obligations set forth herein. To the extent there is an ambiguity or conflict with the Neocash Shopping Rules in other languages, the Neocash Shopping Rules in English governs.
